1. About BidYourDay

BidYourDay is a digital project that allows users to select and purchase individual calendar days. By purchasing a day, the user obtains the right to associate their name, story and other permitted information with that specific day, according to the features available on the platform.

2. User accounts

Some BidYourDay features require the creation of a personal account. Users are responsible for providing accurate and up-to-date information and for keeping their login credentials confidential.

Each account is personal and must not be transferred, sold or used on behalf of another person.

3. Purchasing a day

Available days may be acquired through the purchasing and bidding mechanism provided by BidYourDay.

Each day may receive multiple purchases or bids. The amount required to acquire a day may increase as additional purchases or bids are made, according to the rules and increments displayed on the platform.

A purchase gives the user a temporary position as the current holder of that day. This does not guarantee permanent ownership of the day.

If another user subsequently makes a valid higher purchase or bid, the previous holder loses their position and the new user becomes the current holder.

The purchase is completed only after successful payment confirmation.

Certain days may be subject to a maximum number of purchases or bids. When the applicable limit is reached, bidding for that day will close and no further purchases or bids will be accepted.

The user acknowledges and accepts that participating in the purchase or bidding process does not guarantee that they will ultimately become the final holder of the day.

4. Payments

Payments are processed through the payment methods made available on the platform. BidYourDay does not store users' complete payment card details.

The user is responsible for ensuring that the payment information provided to the payment provider is correct and that they are authorized to use the selected payment method.

5. No returns or refunds

Due to the nature of the BidYourDay service, purchases of calendar days are considered final once payment has been successfully completed.

Purchases cannot be returned, cancelled or refunded merely because another user subsequently makes a higher purchase or bid and the previous holder loses their position.

The possibility of losing the current position as a result of a subsequent valid purchase or bid is an inherent and clearly disclosed characteristic of the BidYourDay service and is accepted by the user when making a purchase.

Deleting a BidYourDay account does not cancel or reverse previous purchases and does not create any right to a refund or reimbursement.

This section does not affect any mandatory rights that cannot legally be excluded under applicable consumer protection law.

Purchases cannot be returned, cancelled or refunded after payment has been completed.

This is because the purchased digital service is immediately associated with the user's account and with the selected calendar day.

Deleting a BidYourDay account does not cancel or reverse previous purchases and does not create any right to a refund or reimbursement.

6. Deleting an account

Users may delete their BidYourDay account at any time through the Private Area, subject to the functionality available on the platform.

Account deletion permanently removes the account and the profile information associated with it, where applicable. However, deleting an account does not entitle the user to receive a refund for purchases previously completed or for any loss of position resulting from the bidding mechanism.

7. User content

Users may provide personal information, photographs, social profiles and stories connected with their purchased days.

By submitting content to BidYourDay, the user confirms that they have the right to provide and use that content and that it does not violate the rights of third parties.

Users must not upload or publish content that is unlawful, defamatory, threatening, discriminatory, obscene, misleading or otherwise inappropriate for the platform.

8. Profile and public information

Information associated with a purchased day may be visible to other visitors depending on the features and public presentation of BidYourDay.

Users should therefore avoid providing information that they do not wish to make publicly accessible.

9. Prohibited use

Users may not use BidYourDay to:

• violate applicable laws or regulations;
• impersonate another person;
• provide false or fraudulent information;
• attempt to interfere with the operation of the platform;
• access another user's account;
• upload malicious software or harmful material;
• use the platform for unlawful commercial or promotional activities.

10. Suspension or termination

BidYourDay reserves the right to suspend or terminate an account where there is reasonable evidence of fraud, abuse, unlawful activity, violation of these Terms or conduct that may harm the platform or other users.

Any action taken under this section does not automatically create a right to reimbursement of previously completed purchases. This does not affect any mandatory rights that may apply under applicable law.

11. Availability of the service

BidYourDay is provided on an evolving digital platform. While reasonable efforts are made to maintain the service, temporary interruptions, maintenance, technical problems or other circumstances may occasionally affect availability.

12. Intellectual property

The BidYourDay name, logo, website design, software, texts and original platform materials are protected by applicable intellectual property laws.

They may not be copied, reproduced, modified or distributed without appropriate authorization.

13. Changes to these Terms

These Terms may be updated when necessary to reflect changes to the service, applicable law or platform functionality. The updated version will be published on this page.

14. Applicable law

These Terms are governed by applicable Italian law, without prejudice to any mandatory consumer protection provisions that may apply.
